The Charter of Democracy (CoD) was signed in London on 14th May 2006 by Benazir Bhutto and Nawaz Sharif. Today, that CoD has been demolished methodically by the same parties who had penned it. The lust for power was too big a temptation, and Imran Khan had become a major obstruction in the path, so therefore they took a U-turn and destroyed democracy, leaving it in shambles.
Democracy can only progress when there is civil supremacy. The 1973 Constitution spelled it out for the people of Pakistan. In the CoD, both parties had committed to end military intervention and vowed never to seek military backing for power. They went back on their word and went for a regime change supported by General Bajwa. Today we have a government which is proud to call itself a "hybrid regime." The most vocal proponent of this regime is Khawaja Asif, the Defense Minister. We wonder when Nawaz Sharif is going to support it. I wish Benazir was here today to see what her son has done to the 1973 Constitution. Both parents who signed that CoD are responsible for destroying democracy.
A democratic setup flourishes and grows under an independent judiciary. The Supreme Court has always been considered as the custodian of the Constitution. Both the parties had committed to an independent judiciary in the CoD. Today, both the parties are responsible for undermining the independence of the judiciary through the 26th Amendment. It is now a toothless tiger, malleable to the hybrid regime.
Benazir Bhutto and Nawaz Sharif had agreed to an independent Election Commission in the CoD. The current ECP was fully involved in the manipulation of the 8th February 2024 election. The mandate of the people of Pakistan was stolen and given to the Form 47 government. What a shame. We are sure Nawaz Sharif must be feeling very embarrassed—after all, it was his narrative: "Vote ko izzat do" (Respect the vote). However, the love for his daughter probably supersedes all the saner thoughts. The term of the current CEC and two members of the ECP has expired. A constitutional amendment was brought about for the continuation of the present CEC. He had to continue—otherwise, who would have given the reserved seats of Tehreek-e-Insaf to the other parties? Now that the deed has been done and the last nail in the coffin of democracy has been hammered in, he can go home in peace. He has managed to give a clear majority to the hybrid regime.
According to the CoD, all important decisions were to be debated and approved in the Parliament. But today, all important decisions are made outside of the Parliament. The status of the Parliament has been reduced to a rubber stamp.
Amendments in the NAB Ordinance have rendered it another toothless entity. However, it is still an effective tool for political engineering and political witch-hunting. The police have been weaponized against the public. CoD said there will be no political victimization and political tolerance will be practiced, whereas the worst form of political victimization has occurred for the last three years. The Tehreek-e-Insaf workers have been deprived of their basic fundamental rights. There is no more protection of the chadar (veil) and chardeewari (four walls of the home / sanctity of private life). Human rights exist no more.
Media freedom was another important commitment under CoD. However, under the new PECA Act, media freedom has been completely compromised. Dissent has been crushed, and independent-minded journalists have been arrested, imprisoned, and taken off the screens.
All the above narrative shows that the two main signatories of the CoD have undermined and destroyed the CoD in letter and in spirit.
Today, all five of us, incarcerated at Kot Lakhpat Jail for the last two years and two months without any conviction and without bail, are fully supportive of Imran Khan’s stand on democracy. We believe in the rule of law. We believe in the 1973 Constitution. We believe in an independent judiciary and Election Commission, and we believe in human rights. We shall continue standing up for the rights of the people of Pakistan.

چارٹر آف ڈیموکریسی (CoD) پر 14 مئی 2006 کو لندن میں بے نظیر بھٹو اور نواز شریف نے دستخط کئیے ۔ آج وہی چارٹر ان ہی جماعتوں کے ہاتھوں منظم طریقے سے روند دیا گیا ہے جنہوں نے اسے تحریر کیا تھا۔ اقتدار کی ہوس بہت بڑی آزمائش ثابت ہوئی، اور جب عمران خان ان کے راستے کی سب سے بڑی رکاوٹ بنے، تو انہوں نے یو ٹرن لیا اور جمہوریت کو نیست و نابود کر دیا، یہاں تک کہ اس کی بنیادیں ہلا دی گئیں۔
جمہوریت صرف اس وقت ترقی کرتی ہے جب سویلین بالادستی ہو۔ 1973 کا آئین اس بات کو واضح طور پر پاکستانی عوام کے لیے بیان کرتا ہے۔ چارٹر آف ڈیموکریسی میں دونوں جماعتوں نے اس بات کا عہد کیا تھا کہ وہ فوجی مداخلت کو ختم کریں گی اور اقتدار حاصل کرنے کے لیے کبھی فوج کی حمایت نہیں لیں گی۔ لیکن وہ اپنے وعدے سے پھر گئیں اور جنرل باجوہ کی پشت پناہی سے رجیم چینج کی راہ ہموار کی گئی۔ آج ہمارے پاس ایک ایسا حکومتی نظام موجود ہے جو خود کو فخریہ "ہائبرڈ رجیم" کہتا ہے، اور اس نظام کا سب سے زیادہ پرچار کرنے والا شخص موجودہ وزیرِ دفاع خواجہ آصف ہے۔ ہم سوچتے ہیں کہ نواز شریف کب اس نظام کی کھل کر حمایت کریں گے؟
کاش بے نظیر بھٹو آج زندہ ہوتیں اور دیکھ سکتیں کہ ان کے بیٹے نے 1973 کے آئین کے ساتھ کیا سلوک کیا ہے۔ افسوس کے ساتھ کہنا پڑتا ہے کہ دونوں والدین، جنہوں نے چارٹر پر دستخط کیے، آج جمہوریت کے زوال کے ذمہ دار ہیں۔
ایک جمہوری نظام صرف آزاد عدلیہ کے ذریعے ہی پروان چڑھتا ہے۔ سپریم کورٹ ہمیشہ آئین کا محافظ سمجھی جاتی رہی ہے۔ چارٹر میں دونوں جماعتوں نے آزاد عدلیہ کے قیام کا وعدہ کیا تھا، لیکن آج وہی جماعتیں 26ویں ترمیم کے ذریعے عدلیہ کی خودمختاری کو پامال کرنے کی ذمہ دار ہیں۔ عدلیہ کو ایک بے اثر، بے دانت شیر بنا دیا گیا ہے، جو ہائبرڈ رجیم کے سامنے جھک چکی ہے۔
بے نظیر بھٹو اور نواز شریف نے ایک آزاد الیکشن کمیشن پر اتفاق کیا تھا۔ لیکن موجودہ الیکشن کمیشن نے 8 فروری 2024 کے انتخابات میں بھرپور کردار ادا کیا، جس کے ذریعے عوام کا مینڈیٹ چرایا گیا اور اسے فارم 47 کی حکومت کے حوالے کر دیا گیا۔ کیا شرم کا مقام ہے۔ ہمیں یقین ہے کہ نواز شریف کو ضرور شرمندگی محسوس ہو رہی ہوگی، آخرکار یہی ان کا بیانیہ تھا: "ووٹ کو عزت دو"۔ تاہم، لگتا ہے کہ بیٹی کی محبت نے ہر اصول پر فوقیت حاصل کر لی ہے۔
موجودہ چیف الیکشن کمشنر اور دو ممبران کی مدتِ ملازمت ختم ہو چکی تھی، مگر ایک آئینی ترمیم کے ذریعے ان کو برقرار رکھا گیا—صرف اس لیے کہ تحریکِ انصاف کی مخصوص نشستیں دوسری جماعتوں کو دی جا سکیں۔ اب جبکہ یہ کام مکمل ہو چکا ہے، اور جمہوریت کے تابوت میں آخری کیل ٹھونک دی گئی ہے، تو وہ اطمینان سے گھر جا سکتے ہیں۔ انہوں نے ہائبرڈ رجیم کو ایک جعلی اکثریت عطا کر دی ہے۔
چارٹر آف ڈیموکریسی کے مطابق تمام اہم فیصلے پارلیمنٹ میں بحث کے بعد منظور ہونے تھے، مگر آج تمام بڑے فیصلے پارلیمنٹ سے باہر کیے جا رہے ہیں۔ پارلیمنٹ کو ایک ربڑ اسٹیمپ بنا کر رکھ دیا گیا ہے۔
نیب آرڈیننس میں ترامیم نے اسے بھی ایک بے اثر ادارہ بنا دیا ہے، تاہم یہ اب بھی سیاسی انتقام اور انجینئرنگ کا موثر ہتھیار ہے۔ پولیس کو عوام کے خلاف بطور ہتھیار استعمال کیا جا رہا ہے۔ چارٹر میں سیاسی انتقام نہ لینے اور سیاسی برداشت کا وعدہ کیا گیا تھا، لیکن پچھلے تین سالوں میں بدترین سیاسی انتقام دیکھنے کو ملا ہے۔ تحریکِ انصاف کے کارکنوں کو ان کے بنیادی حقوق سے محروم کر دیا گیا ہے۔ چادر اور چار دیواری کی حرمت ختم کر دی گئی ہے۔ انسانی حقوق اب ناپید ہیں ۔
میڈیا کی آزادی بھی چارٹر کا ایک اہم وعدہ تھا۔ لیکن نئے PECA قانون کے تحت میڈیا کی آزادی کو مکمل طور پر ختم کر دیا گیا ہے۔ اختلاف رائے کو کچل دیا گیا ہے، اور خودمختار صحافیوں کو گرفتار کر کے جیلوں میں ڈال دیا گیا ہے اور ٹی وی اسکرینوں پر ان پر پابندی عائد کر دی گئی ہے۔
اوپر بیان کردہ تمام حقائق اس بات کا ثبوت ہیں کہ چارٹر آف ڈیموکریسی کے دونوں بنیادی دستخط کنندگان نے نہ صرف اس کی روح، بلکہ اس کے متن کو بھی پامال کر دیا ہے۔
آج ہم پانچوں، جو پچھلے دو سال اور دو مہینے سے بغیر کسی سزا اور بغیر کسی ضمانت کے کوٹ لکھپت جیل میں قید ہیں، عمران خان کے جمہوری مؤقف کی مکمل حمایت کرتے ہیں۔ ہم آئین کی بالادستی، آزاد عدلیہ، آزاد الیکشن کمیشن اور انسانی حقوق پر یقین رکھتے ہیں۔ ہم پاکستان کے عوام کے حقوق کے لیے اپنی جدوجہد جاری رکھیں گے۔
